Can You Buy Riviera Property Without an Ownership Certificate?
Foreigners can buy apartments in Albania, but acquiring property along the Riviera without a Cadastre ownership certificate carries major risks. Here is what to check.
Can you legally purchase coastal property in Albania if the owner lacks an official certificate? Under Albanian legislation, foreign individuals are permitted to purchase residential apartments, though they cannot directly acquire agricultural acreage or bare rural plots as natural persons. However, any secure purchase relies on one non-negotiable document: the ownership certificate (*Certifikatë Pronësie*) granted by the State Cadastre Agency (ASHK).
Along the Albanian Riviera, numerous seaside developments and older parcels are marketed using preliminary building agreements (*kontratë porosie*) or initial permits rather than finalized title deeds. Entering into an agreement without a clean Cadastre entry carries severe legal peril, as the asset cannot be formally registered in your name until full legalization and registration take place.
To safeguard your capital, every valid property transaction must be concluded in the presence of a licensed Albanian public notary (*noter*). The notary reviews the official cadastral records, prepares the formal deed, and manages a protected escrow account (*llogari ruajtjeje*). Purchase funds remain securely deposited in this escrow account and are released only upon successful title transfer. Never wire funds or deposits directly into a private seller's or builder's personal account. Finally, always hire an independent, bilingual real estate lawyer (*avokat*) unconnected to the vendor to thoroughly examine historical restitution claims and ownership chains before signing.
